Terms of Service — Sourced CRM

Please read these Terms of Service carefully before using the Sourced CRM platform or website. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Sourced CRM LLC governing your use of our website at sourcedcrm.com and the CRM platform services we provide. By creating an account or making a purchase, you represent that you are at least 18 years of age and agree to these Terms in full.

2. Description of Services

Sourced CRM provides a CRM platform built on GoHighLevel infrastructure, configured specifically for real estate wholesalers. Our Services include:

CRM and contact management tools
SMS and email outreach capabilities
Pipeline and deal management features
Automated follow-up workflows
A2P 10DLC registration management
Onboarding, support, and account management services

3. Subscription, Fees, and Payment

Our Services are offered on a subscription basis. Current pricing:

Blank Canvas: $250 one-time setup fee + $100/month
Full Arsenal: $1,250 one-time setup fee + $100/month

All setup fees are non-refundable once onboarding work has begun. Monthly subscription fees are billed in advance on a recurring basis. We reserve the right to change pricing with 30 days' written notice to existing subscribers.

4. Cancellation and Refunds

You may cancel your subscription at any time with no cancellation fees. Cancellation takes effect at the end of the current billing period. Monthly fees are non-refundable once charged. Setup fees are non-refundable once onboarding has commenced. Contact us at sourced@sourcedcrm.com within 30 days if you believe you were charged in error.

5. Acceptable Use

You agree to use the Services only for lawful purposes. You agree NOT to:

Send unsolicited messages in violation of the CAN-SPAM Act, TCPA, or any applicable law
Send SMS to individuals who have not consented or who have opted out
Upload lists containing data obtained unlawfully
Misrepresent your identity or business in outreach messages
Attempt to gain unauthorized access to the platform or infrastructure

Violation of these requirements may result in immediate suspension or termination without refund.

6. TCPA Compliance

The Telephone Consumer Protection Act (TCPA) places strict requirements on SMS and telephone marketing. By using our SMS features, you represent and warrant that:

You have obtained prior express written consent from all recipients before sending marketing SMS messages
All contacts in your uploaded lists have consented to receive text messages from you
You will honor all opt-out requests immediately and permanently
Your messaging includes required opt-out language (e.g., "Reply STOP to opt out")
You will comply with all TCPA requirements, FCC regulations, and applicable state laws

Sourced CRM provides A2P 10DLC registration and compliance infrastructure as a service. However, you — the user — are solely responsible for ensuring that your use complies with all applicable laws. Sourced CRM assumes no liability for TCPA violations arising from your messaging activity.

7. Intellectual Property

The Services and all content are owned by Sourced CRM or our licensors and are protected by applicable intellectual property laws. You retain ownership of all data and content you upload or create within the platform.

8. Data and Privacy

Your use of the Services is also governed by our Privacy Policy, incorporated into these Terms by reference. You may export your data at any time. Upon cancellation, we retain your data for up to 90 days before deletion unless you request earlier removal.

9. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOURCED CRM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.

10. Termination

Either party may terminate the subscription at any time. We reserve the right to suspend or terminate your access immediately if we determine you have violated these Terms or applicable law.

11. Governing Law

These Terms shall be governed by the laws of the United States and the state in which Sourced CRM LLC is registered. Disputes shall first be addressed through good-faith negotiation, then submitted to binding arbitration under the American Arbitration Association rules.
